What a California Personal Injury Claim Actually Involves
A personal injury claim is a demand for money from the person or company whose carelessness hurt you, and from their insurance company. Four things have to line up. They owed you a duty of reasonable care. They broke it. That breach caused your injury. The injury cost you something measurable. Most claims are won or lost on the last two points, not the first two.
California is a pure comparative fault state. If a jury finds you 20 percent responsible for the crash, your recovery drops by 20 percent, and it never drops to zero [Li v. Yellow Cab Co.
